NMC Allows Personal Hearing to 118 applicants with Pending Eligibility Certificates, Details

New Delhi: Offering an opportunity for a personal hearing of cases pertaining to pending eligibility certificates, the Ethics and Medical Registration Board (EMRB) of the National Medical Commission (NMC) has published a list of 118 medicos.

The Apex Medical Commission has decided to hear these candidates in three batches between September 22, 2023 to September 27, 2023. The cases of 40 students will be heard on 22.09.2023, another 40 students will be given the opportunity for personal hearing on 25.09.2023 and the cases of the remaining 38 students will be heard on 25.09.2023, informed NMC.

Issuing a Public notice in this regard on 19.09.2023, the NMC Ethics Board further informed that it has scrutinized the records up to the year 2021 and apart from these 118 candidates, it has identified another 137 cases, in which the process is pending with the Ministry of Home Affairs for Security Clearance to address National Security concerns. 

Addressing these 137 cases out of the total 255 cases scrutinized by NMC, the Commission informed that these cases cannot be proceeded further without security clearance. 

It is mandatory for medical graduates from abroad to clear the FMGE test in order to get registered and practice in India. However, the doctors cannot register or appear in the FMGE test without an eligibility certificate. Despite completing all the required procedures in this regard, several candidates were facing problems in obtaining the mandatory eligibility certificate from the Apex Medical Commission.

Medical Dialogues had earlier reported that even the FMGs who applied in 2021, 2022, and earlier months of 2023 were facing the problem. Their applications were pending at some level and they were not getting the certificates. Therefore, they were missing their chances to appear in the FMGE test.

NMC Ethics Board on 19.09.2023 issued a public notice and informed its decision to allow personal hearings of pending eligibility certificate cases pertaining to the 01.01.2018 to 31.12.2021, on the basis of the receipt of applications for issue of Eligibility Certificate as per the portal.

"Ethics & Medical Registration Board (EMRB) has decided to allow personal hearing to the applicants whose eligibility certificates are pending with the EMRB, NMC despite having been deficient since long for want of information from the applicant / other reasons," NMC mentioned in the notice.

"In this regard, the records upto year 2021 (on the basis of receipt of applications for issue of Eligibility Certificate as per the portal) have been scrutinized and 255 cases have been found out of which 137 cases are pending with MHA for Security Clearance to address National Security concerns and cannot be proceeded further without security clearance. With respect to the remaining 118 cases, it has been decided to give them an opportunity to be heard in person in batches and on basis of date of receipt of their applications to expedite the processing of the eligibility certificates," it further added.

NMC announced that these cases will be heard in 3 batches, and published the list of serial numbers, batches, and date of hearing as under:

Therefore, the Ethics Board of NMC has requested these candidates "to kindly make it convenient to attend the personal hearing with a copy of self-attested documents and original documents."

"In case the opportunity provided is not availed, it will be presumed that they are not interested in a personal hearing and accordingly no further opportunity shall be given," further stated the notice issued by the Director of EMRB, Raj Krishnan Bhoria.

Along with the notice, NMC has also published a list of 118 candidates with respect to the records of Eligibility Cases pertaining to years 2018 to 2021 (On the basis of receipt of applications as per EC portal).

The details that have been published by the Commission include serial number, year of application received, application name, application ID, batch, and scheduled date of personal hearing.

On April 18, 2023, NMC gave a deadline of 30 days for applicants to fulfill the deficiencies in their eligibility certificates and published a list of 2875 candidates whose applications were pending with the initiator.

Since these deficiencies in the applications were not addressed even after four months, NMC recently closed and rejected the pending applications of 2316 students.

Earlier this year, the Union Minister of State for Health, Dr. Bharati Pravin Pawar addressed the issue of Foreign Medical Graduates (FMGs) and informed the Lok Sabha that the delay in issuing eligibility certificates to the FMGs occurs due to delay in the validation of documents submitted by the candidates, verification of admission letter from the foreign medical institutions.
